1. Acceptance of Terms

By accessing VR Exotic Club's facilities, website, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Agreement

These terms constitute a legally binding agreement between you and VR Exotic Club Inc., a corporation registered in Ontario, Canada. This agreement governs your use of all VR gaming services, equipment, and facilities provided by VR Exotic Club.

Modifications

We reserve the right to modify these terms at any time. Changes will be posted on our website and, where required by law, communicated directly to registered users. Continued use of our services after modification constitutes acceptance of the updated terms.

2. Eligibility and Age Requirements

General Eligibility

VR Exotic Club services are available to individuals aged 8 years and older, subject to the following conditions:

  • Ages 8-12: Must be accompanied by a parent or legal guardian at all times
  • Ages 13-17: May participate independently with signed parental consent form
  • Ages 18+: Full access to all experiences and services

Health and Safety Restrictions

Participation is subject to health and safety assessments. The following conditions may restrict access:

  • History of epilepsy or photosensitive seizures
  • Severe motion sickness or balance disorders
  • Recent eye, head, or neck injuries
  • Pregnancy (recommendation to consult healthcare provider)
  • Heart conditions exacerbated by excitement or stress
  • Intoxication from alcohol or controlled substances

3. Facility Rules and Code of Conduct

Behavioral Expectations

All participants must maintain appropriate conduct while using VR Exotic Club facilities:

  • Treat staff, equipment, and other participants with respect
  • Follow all safety instructions and equipment handling guidelines
  • Avoid inappropriate, offensive, or disruptive behavior
  • Respect the virtual and physical space of other participants
  • Report any equipment issues or safety concerns immediately
  • Maintain appropriate hygiene and cleanliness standards

Prohibited Activities

The following activities are strictly prohibited and may result in immediate removal:

  • Intentional damage to VR equipment or facility property
  • Recording or photographing other participants without consent
  • Bringing food, drinks, or outside equipment into VR areas
  • Attempting to bypass safety systems or access restricted content
  • Harassment, discrimination, or threatening behavior
  • Sharing or selling facility access without authorization

4. Booking, Payment, and Cancellation Policies

Booking Requirements

To ensure the best experience and equipment availability:

  • Advance booking recommended, especially for weekends and evenings
  • Valid photo ID required for all participants over 18
  • Group bookings (6+ people) require 48-hour advance notice
  • Special event bookings subject to separate terms and pricing

Payment Terms

Payment policies for VR Exotic Club services:

  • Individual Sessions: Payment due at time of service
  • Monthly Memberships: Charged monthly in advance via automatic billing
  • Group Events: 50% deposit required, balance due on service date
  • Corporate Packages: Net 30 payment terms available for qualified accounts
  • Taxes: All prices subject to applicable HST and local taxes

Cancellation and Refund Policy

  • Individual Sessions: Free cancellation up to 2 hours before scheduled time
  • Group Bookings: 24-hour cancellation notice required for full refund
  • Monthly Memberships: Cancel anytime, effective end of current billing period
  • No-Shows: Charged full session fee unless emergency circumstances
  • Refunds: Processed within 5-7 business days to original payment method

5. Liability and Risk Assumption

Assumption of Risk

By participating in VR experiences at VR Exotic Club, you acknowledge and assume the following risks:

  • Potential for motion sickness, dizziness, or disorientation
  • Risk of collision with objects or other participants
  • Possible eye strain or temporary vision effects
  • Physical exertion and potential for overexertion
  • Psychological effects from intense or startling VR content

Limitation of Liability

VR Exotic Club's liability is limited as follows:

  • Total liability limited to the amount paid for services on the date of incident
  • No liability for indirect, consequential, or punitive damages
  • Equipment failure resulting in session interruption eligible for session credit only
  • Personal property loss or damage not covered unless due to facility negligence
  • Medical expenses resulting from pre-existing conditions not covered

Insurance and Medical Coverage

Participants are responsible for their own health insurance coverage. VR Exotic Club maintains general liability insurance for facility operations but does not provide medical coverage for participant injuries or health issues.

6. Intellectual Property and Content Usage

VR Content and Software

All VR experiences, software, and digital content provided by VR Exotic Club are protected by copyright and other intellectual property laws:

  • Content licensed for facility use only, not for personal copying or distribution
  • Recording, streaming, or redistributing VR experiences strictly prohibited
  • Custom content developed by VR Exotic Club remains our exclusive property
  • Third-party content subject to respective owners' licensing terms

User-Generated Content

For experiences allowing user-generated content or personalization:

  • Users retain ownership of original content they create
  • VR Exotic Club may use user content for service improvement and marketing (with consent)
  • Users must ensure their content doesn't infringe third-party rights
  • Inappropriate user content will be removed without notice

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our comprehensive Privacy Policy. Key points include:

  • Limited collection of personal information necessary for service delivery
  • Secure storage and processing of all personal data
  • No sale of personal information to third parties
  • Compliance with Canadian privacy legislation (PIPEDA)
  • User rights to access, correct, and delete personal information

8. Dispute Resolution and Governing Law

Governing Jurisdiction

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario, Canada.

Dispute Resolution Process

  1. Direct Communication: Contact our customer service team to resolve issues informally
  2. Mediation: Unresolved disputes may be referred to mediation through ADR Chambers
  3. Legal Action: Court proceedings as a last resort, subject to limitation periods

Class Action Waiver

Where permitted by law, participants agree to resolve disputes individually and waive the right to participate in class action lawsuits against VR Exotic Club.

9. Business Continuity and Service Changes

Service Availability

VR Exotic Club strives to provide consistent service but reserves the right to:

  • Modify operating hours due to maintenance, technical issues, or unforeseen circumstances
  • Update VR content, equipment, or experiences without prior notice
  • Temporarily close facilities for renovations or regulatory compliance
  • Adjust pricing with 30 days notice to existing members

Business Transfer

In the event VR Exotic Club is sold, merged, or transfers assets, these terms will remain in effect unless superseded by new ownership with appropriate notice to users.

11. Severability and Entire Agreement

If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. These terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and VR Exotic Club regarding the use of our services.

No waiver of any term or condition will be deemed a waiver of any other term or condition, and any waiver must be made in writing by an authorized representative of VR Exotic Club.
